Introduction and Scope of Services

Intimate Africa Pty Ltd operates a website under https://www.intimate.africa & http://www.intimateafrica.co.za (including its social media channels and mobile applications, jointly the “Platform”) where travellers book vacations, transport,  accommodation and travel services. Travellers can also use the Platform to participate in competitions, write reviews and enjoy other related offers hosted or affiliated with Intimate Africa. 

These terms and conditions apply to all Intimate Africa Services and govern the rights and obligations arising out of the Traveler’s use of the Platform.  

By accessing, browsing or using the Platform, you agree to be bound by these terms and conditions. Please read these terms and conditions and our privacy policy carefully.

Terms of Use of the Platform

1. Intimate Africa operates the Platform on which travellers can book travel services such as multi-day tours, cruises, adventure trips, luxury travels and other travel activities (individually or jointly “Travel Adventures”) 
2. The Intimate Africa Services are solely for persons who are aged 18 years or older. Any access to or use of the Platform by anyone under 18 years is expressly prohibited. By accessing or using the Services and the Platform you guarantee that you are 18 years or older.
3. If you are acting on behalf of a company or another legal entity you guarantee that you are legally entitled to accept these terms and conditions in their name.

Prohibited Conduct

1. Intimate Africa Services are only available for private, non-commercial use. It is not allowed to sell, re-sell, re-use or commercially use content, information, software, products or services available on our Platform.
2. Further, it is prohibited to:
3. Use bots, crawlers, scrapers or other automated means (besides authorized use of our API) to access or interact with the Platform or generally collect data or content not in connection with your booking.
4. Circumvent established security or technological barriers in place to protect the Platform and its content.
5. Decrypt, decompile, reverse engineer or copy the website and Platform.
6. Otherwise, compromise or damage the Platform and its proper functioning.

Content and Intellectual Property

1. Intimate Africa may, in its sole discretion, permit you to post, upload, publish, submit or transmit text, graphics, images, video or other materials (“Content”) on the Platform and through the Intimate Africa Services. By making available any Content, you agree that Intimate Africa may use the Content on the Platform, in particular for promotional materials and publications. You hereby grant to Intimate Africa a worldwide, irrevocable, perpetual, non-exclusive, royalty-free license to publicly display or otherwise use the Content for the aforementioned purpose. Intimate Africa does not claim any ownership rights in any such Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit the Content.
2. You acknowledge and agree that you are solely responsible for all Content that you make available on the Platform or through Intimate Africa services. Accordingly, you represent and warrant that: (a) you either are the sole and exclusive owner of all Content or you have all rights, licenses, consents and releases that are necessary to grant to Intimate Africa the rights in such Content, as contemplated under these terms and conditions; and (b) neither the Content nor your posting, uploading, publication, submission or transmittal of the Content or Intimate Africa’s use of the Content (or any portion thereof) on, through or using the Services will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
3. It is not allowed to upload or submit Content that (i) is illegal, pornographic, incites hate, obscene or defamatory; (ii) contains commercial content, especially advertisement or marketing for other good or services (iii) infringes intellectual property rights of others (iv) contains viruses, malware, trojan horses or other infested files. Intimate Africa is not obliged to check any Content ex-ante. Content that violates this clause can be blocked or removed immediately without notice.

Termination

1. Intimate Africa and registered users can terminate the usage contract anytime with immediate effect.
2. In case of a termination, Intimate Africa is not obliged to delete or revert any content posted by the Traveler on the Platform.
3. The rights and obligations of existing Travel Adventures are not affected by such a termination.

Payments

1. For all the services contracted, a certain advance payment should be made to hold the booking, on a confirmed basis & the balance amount can be paid either before you depart from your country or upon arrival in the country you will be visiting but definitely before the commencement of the services. Management personnel hold the right to decide upon the amount to be paid as advance payment, based on the nature of the service & the time left for the commencement of the service.
2. Apart from the above in some cases like Special Train Journeys, hotels or resorts bookings during the peak season (X-Mas, New Year), full payment is required to be sent in advance.

Mode of Payment

Overseas advance payment can be made through EFT or any other agreed payment to our bank accounts. Any International Payments taxes and levies as determined by the rules and regulations of the Republic of South Africa will be applied to the clients/traveller’s invoice.

Cancellation Policy

In the event of cancellation of tour/travel services due to any avoidable/unavoidable reason/s, we must be notified of the same in writing. Cancellation charges will be effective from the date we receive advice in writing, and cancellation charges will be as follows:

• 45 days before arrival: full deposit
• 21 days before arrival: 50% of the Tour/service cost
• 14 days before arrival: Non-refundable
• Less than 13 days before arrival OR No Show: No Refund

Note: Written cancellation will be accepted on all working days, except Sundays, Any cancellation sent on Sundays will be considered on the next working day (Monday).

For the Christmas and New Year period from 16 Dec to 05 Jan, all payments are non-refundable.

In case you cancel the trip after commencement, no refunds will be issued. For unused hotel accommodation, chartered transportation & missed meals etc. we do not bear any responsibility to refund.

Wildlife Safaris cancellation

All the wildlife safaris booked into any of the South African National Parks and Nature Reserves are nonrefundable. Even a date change request will be considered a cancellation and no payment will be refunded/ adjusted against it.

Our Liabilities & Limitations

1. Please note that after the finalization of the Tour/ service Cost, if there are any Hikes in entrance fees of attractions/nature reserves, Taxes, fuel costs or guide charges – by the government of South Africa or any country intended to be travelled to, the same would be charged as extra.
2. Intimate Africa acts only in the capacity of agent for the hotels, airlines, transporters, railways & contractors providing other services & all exchange orders, receipts, contracts & tickets issued by us are issued subject to terms & conditions under which these services are provided by them.
3. All itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule.
4. Numerous factors such as weather, road conditions, the physical ability of the participants etc. may dictate itinerary changes either before the tour or while on the trail. We reserve the right to change any schedule in the interest of the trip participants’ safety, comfort & general well-being.
5. Our rates are based on the prevailing rates as negotiated by us with the hotels, airlines etc. Hotels and Airlines retain the right to modify the rates without notice. In case of such changes, the rates quoted before the modification can be changed by us according to the modifications by hotels or airlines. All hotel bookings are based on the usual check-in and check-out times of the hotels unless indicated in the itinerary.
6. We shall not be responsible for any delays & alterations in the program or expenses incurred – directly or indirectly – due to natural hazards, flight cancellations, accidents, breakdown of machinery or equipment, breakdown of transport, weather, sickness, landslides, political closures or any untoward incidents.
7. We shall not be responsible for any loss, injury or damage to person, property, or otherwise in connection with any accommodation, transportation or other services, resulting – directly or indirectly – from any act of GOD, dangers, fire, accident, breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, pilferages, epidemics, medical or custom department regulations, defaults, or any other causes beyond our control.
8. We do not have any insurance policy covering the expenses for accidents, sickness, loss due to theft, or any other reasons.
9. Visitors are advised to seek such insurance arrangements in their home country. All baggage & personal property/s at all times are at the client’s risk.

Please Note: We will not be responsible for any costs arising out of unforeseen circumstances like landslides, roadblocks, bad weather, etc.
